ન્યાયતંત્ર વિરુદ્ધ સરકાર 21/10/2015 6:03 am Mukesh Patel ભારતની સર્વોચ્ચ અદાલતે એક સિમાચિહનરૂપ ચુકાદામાં ઉચ્ચ ન્યાયતંત્રમાં ન્યાયાધીશોની નિયુક્તિ કરતી બે દસકા જૂની પાંચ જજોની બનેલી કોલેજિયમ સિસ્ટમના સ્થાને નેશનલ જ્યુડિશિયલ એપોઇન્ટમેન્ટ કમિશન (એનજેએસી) રચવાના કેન્દ્ર સરકારે ઘડેલા કાયદાને ગેરબંધારણીય ઠરાવ્યો છે. અલબત્ત, સુપ્રીમ કોર્ટે આ ચુકાદો આપતાં ન્યાયાધિશોની નિમણૂક કરતી કોલેજિયમ સિસ્ટમને પણ ખામીપૂર્ણ ગણાવીને તેમાં જરૂરી સુધારાવધારા કરવા માટેના સૂચનો પર સુનાવણી યોજી છે. જોકે દેશની સર્વોચ્ચ અદાલતે શુક્રવારે આપેલા આ ચુકાદાએ એક પ્રકારે ન્યાયતંત્ર અને સરકાર વચ્ચે તનાવ સર્જયો છે તેમાં બેમત નથી.
